Board Decision Update

On April 27, 2022, the Surface Transportation Board (Board) issued a decision that will affect the schedule for the environmental review of the proposed acquisition of Kansas City Southern Railway (KCS) by Canadian Pacific Railway (CP). The decision addresses an issue with baseline rail traffic data submitted by CP and KCS and directs them to resubmit certain data by May 27, 2022. The Board’s Office of Environmental Analysis will continue to conduct the environmental review of the proposed acquisition, but will not issue a Draft Environmental Impact Statement until after CP and KCS have resubmitted the data as directed.

Introduction to the Proposed Acquisition

On October 29, 2021, Canadian Pacific Railway Limited, et al. (CP) and Kansas City Southern et al. (KCS) filed an application with the Surface Transportation Board (Board) seeking authorization for CP to acquire KCS. To thoroughly assess potential environmental impacts that may result from the proposed acquisition, the Board’s Office of Environmental Analysis (OEA) is preparing an Environmental Impact Statement (EIS).
